Research Use Only Agreement & Acknowledgement

This Research Use Only Agreement (the "Agreement") governs all purchases of products from Echo Peps ("we", "us"). By creating an account, placing an order, or accepting delivery of any product, you enter into this Agreement on your own behalf and on behalf of any entity you represent.

This Agreement supplements, and does not replace, our Terms of Service. Where the two conflict on matters of permitted product use, this Agreement controls.

At signup and again at each checkout, you must affirmatively accept the following statement. It cannot be waived, skipped, or completed on your behalf by us:

"I understand these products are research chemicals supplied for laboratory research use only, and are not sold or advertised for human consumption."

You additionally acknowledge that you are at least 21 years of age. [NOTE FOR COUNSEL: we deliberately do NOT ask the customer to assert institutional affiliation or professional qualification, because we do not verify either. Requiring an unverified assertion of status was judged worse than not requiring it. Confirm this position is right for your risk posture before launch.]

You may not administer, ingest, inject, inhale, apply topically, or otherwise introduce any product into the body of a human being or a companion animal. You may not resell, repackage, relabel, or redistribute any product for any such use.

You may not use any product in the manufacture of, or as an ingredient in, any drug, food, dietary supplement, cosmetic, or medical device.

You may not represent, in any medium, that a product is safe or effective for human use, or that Echo Peps has made any such representation.

Products are supplied as laboratory reagents. They are not drugs, foods, dietary supplements, cosmetics, or medical devices. They have not been reviewed or approved by the U.S. Food and Drug Administration or any comparable authority for any use in humans or animals.

Products are not sterile pharmaceutical preparations and are not manufactured under drug GMP. Analytical certificates speak only to identity, purity, and the specific attributes stated on them.

You are solely responsible for the safe handling, storage, use, and disposal of products once delivered, and for compliance with all applicable institutional, local, state, national, and international requirements — including any required institutional review, biosafety approval, or licensing.

You are responsible for determining whether receipt or possession of a given product is lawful in your jurisdiction before ordering.

We retain a record of each acknowledgement, including the exact wording accepted, the account that accepted it, and a timestamp. [CONFIRM WITH COUNSEL: whether IP address and user agent should also be retained, and for how long — this interacts with the Privacy Policy.]

Providing a false acknowledgement is a material breach of this Agreement and may result in immediate account termination, cancellation of pending orders, and referral to the appropriate authorities.

You agree to indemnify and hold harmless Echo Peps and its officers, employees, and suppliers against any claim, loss, liability, or expense arising out of your use of any product in breach of this Agreement, including any use in or on a human subject.
